OJ Simpson Granted Parole

Update: the vote was unanimous for parole among the four board/commission members. Each spoke individually. They said their vote was fair and consistent.

Update: Looks like OJ will get parole. They have a Florida parole officer explaining the procedures for transfer from Nevada to Florida.

OJ told his version of the robbery he was convicted of during the hearing. It's live on CNN and other channels now.

My view: OJ should get and will get parole. [More...]

O.J. Simpson Loses Bid for New Trial

A Las Vegas judge has denied O.J. Simpson's bid for a new trial. Lawyers for Simpson argued at a hearing held months ago that his trial counsel was ineffective and had a conflict of interest. From the opinion:

“Mr. Simpson failed to demonstrate that counsel experienced an actual conflict of interest that substantially impacted counsel’s performance at trial. Mr. Simpson also failed to establish that the State withheld exculpatory evidence. Finally, Mr. Simpson failed to establish that appellate and trial counsel were ineffective or that any deficient performance by counsel resulted in prejudice. Given the overwhelming amount of evidence, neither the errors in this case, nor the errors collectively, cause this court to question the validity of Mr. Simpson’s conviction.”

Simpson's current attorney says he will appeal to the Nevada Supreme Court, and if he loses, file a habeas action in federal court.

O.J. Simpson Granted Parole on Some Counts

Last week the Nevada Board of Parole held a hearing on O.J. Simpson's request for parole. You can watch the hearing here.

The parole board has granted his request, but since on some counts, the sentences were consecutive, he could have to serve up to four more years.

OJ's motion for a new trial based on ineffective assistance of counsel is still pending.

Galanter Throws O.J. Simpson Under the Bus

O.J. Simpson's former attorney, Yale Galanter, threw O.J. under the bus today, testifying O.J. told him he knew others were bringing guns to the hotel room where O.J. planned to retrieve his possessions. He even said O.J. told him he asked the others to bring the guns (called "heat.")

He also testified he told O.J. not to engage in the plan.

"He told me he finally had a lead on some personal pictures and memorabilia that was stolen from him years earlier," Galanter testified. "I said, 'O.J., you've got to call the police.'"

O.J. Simpson in Court for Hearing on Motion for New Trial

O.J. Simpson is in court today, seeking a new trial in his Nevada robbery and kidnapping case. The grounds: ineffective assistance of counsel. His lawyer, Yale Galanter, denies the allegations.

Galanter is also being sued in federal court by his local co-counsel in the case, Gabriel Grasso. Grasso alleges he had an oral agreement with Galanter to be paid $250,000 in legal fees for his participation in the defense. Grasso says he expended over 1,000 hours and expended thousands in costs. He says Galanter received $500,000 for defending OJ and never paid him anything other than a partial cost reimbursement of $15,000. In pleadings obtained from PACER, Galanter argues there was no written fee agreement with Grasso and under Nevada ethical rules, it would be improper to share fees with another lawyer without the written permission of the client. 16 Years Ago Today, O.J. Simpson Acqutted

Here's Johnny Cochran: "If it doesn't fit, you must acquit...." (4 min. 30 seconds in). Another great line: "They allowed this investigation to be infected by a dishonest and corrupt detective."

O.J. Simpson Nevada Conviction Upheld, Co-Defendant's Reversed

The Nevada Supreme Court today upheld O.J. Simpson's convictions for armed robbery and kidnapping.

The opinion is here.

The Court reversed the conviction of his co-defendant, saying he should have received a separate trial due to, among other things, the prejudice of being tried with O.J. The opinion is here.

When will he be eligible for parole on the 33 year sentence? My best guess, 9 years.

O.J. Simpson Bail Hearing Tomorrow

The Nevada Supreme Court will hold oral arguments tomorrow on O.J. Simpson's request for bail pending appeal of his 2008 armed robbery conviction. He was sentenced to 9 to 33 years in prison and bail pending appeal was denied. His lawyers appealed.

The Court spokesperson says no national networks have requested parking space for satellite trucks at the hearing. O.J. will not be there.

If you are interested, the court will be live-casting the argument at 10:00 a.m. PT. It won't be archiving the hearing so you can only watch at that time.

O.J. Simpson Sentenced for Las Vegas Robbery

Update: Bail pending appeal denied. The sentence:

Count 1: 1 year county jail; Count 2: 12 - 48 mos, concurrent with count1; Count 3: 12 - 48 mos concurrent with counts 1 and 2; Count 4: 26 mos to 120 mos; Count 5: 15 years, parole eligibility after 5 yrs, consecutive 12 - 72 mos; Count 6: 15 years, parole eligibility after 5 yrs, consecutive 12 - 72 mos, concurrent with count 5; Count 7: 60 - 180 mos, consecutive 12-72 months; Count 8: 60 - 180 mos, consecutive 12-72 months, concurrent with count 7; Count 9: 18 - 72 mos, consecutive to ct 8; Count 10: 18 - 72 mos, consecutive to ct 9.

How much time did he get? At first glance, it looks to me like he has to do at least 6 years on counts 1 through through 8, and then two additional sentences of 1.5 to 6 years each on counts 9 and 10, meaning a minimum of 6 + 3 (1.5 + 1.5) for a total minimum of 9 years. Appeal Grounds for O.J. Simpson

Update: The judge released jury questionnaires today.

Jury questionnaires released Saturday show that five of the 12 jurors disagreed with the 1995 verdict that cleared Simpson of murdering his ex-wife and her friend in Los Angeles.

O.J. Simpson is sitting in the Clark County, NV jail today, undoubtedly wondering whether he has any strong grounds for appeal of last night's jury verdict in his Las Vegas robbery/kidnapping trial.

O.J. Guilty on All Counts - Live Blog

The verdict in the O.J. Simpson trial is about to be read. Streaming live site is here or here.

It was 13 years ago today that the jury reached a not guilty verdict in his murder trial.

The jury has been deliberating since 8:30 a.m. this morning. The jury instructions are here (pdf). From the Las Vegas Sun:

The charges they face include 11 felonies (Conspiracy to commit kidnapping; conspiracy to commit burglary; burglary while in possession of a deadly weapon; and two counts each of first degree kidnapping with use of a deadly weapon; robbery with use of a deadly weapon; assault with a deadly weapon; and coercion with use of a deadly weapon. They also face one gross misdemeanor, conspiracy to commit a crime.

The jury has the power to drop "use of a deadly weapon" from the nine weapons-related charges if they choose to do so.

I watched the closing arguments this afternoon at The Legal Edge. I finished feeling nervous for O.J., thinking he needs a holdout. With the verdict coming in this soon, I'm not optimistic he got one. And yes, I'm rooting for O.J.

O.J. Simpson Held on Bail Violation

O.J. Simpson is back in custody pending a bail violation hearing next week in Nevada. The prosecutor filed this complaint (pdf) alleging he left a voicemail for his bondsman asking him to contact a co-defendant, Clarence Stewart, who is not cooperating, and tell him to not to change his story from what he had previously told O.J. O.J.'s voicemail:

"I just want, want C.J. to know that the whole thing all the time he was tellin' me that (bleep), ya know. I hope he was telling me the truth. Don't be trying to change the mother (bleeping) (bleep) now, mother (bleeping) (bleep) holes. I'm tired of this (bleep). Fed up with the mother (bleepers) changing what they told me."

A condition of O.J.'s bond is that he not contact witnesses, victims or co-defendants personally or through his agents.
